There may be scenarios when the employer has difficulty to decide if the employee pass the 120day probation period as he is still not satisfied with the employee performance. But employer still wants to give the employee another chance to improve his performance. In other countries, employer will extend the probation period by 3 or 6 months. But for Thailand, I know that Thai labour states that probation period is strictly 120days.
So my question is: In these type of situation, can the employer review the employee’s performance further by placing the employee on a e.g. 3-month performance improvement plan after the probation period? In the plan, targets and objectives are set out for employee to improve his performance. If employee still does not meet the objectives, employer may consider to terminate employment. Can this be done?
