Provided the lease agreement between Lessor and Lessee, signed on [INSERT DATE] continues and remains in effect, Lessor will charge to Lessee for Electric supply through IPP 115Kv Sub Station on 10.048% on monthly bill, to the agreed service level and building/power specification, set out in the schedule to this services agreement. This agreement will valid after Lessee sigh on this agreement, and shall immediately terminate when the lease agreement terminates. Charges for electricity supply shall be fixed for the term of the lease agreement, and shall only be negotiated/adjusted by mutual consent between the parties, and only in relation to any increase and/or decrease in the base power charge paid by the Lessor to a wholesale electrical provider.
2. Lessee shall have the right to terminate this service agreement on 30 days prior written notice, where Lessor fails to remedy a breach of this service agreement, within the same 30 day notice period.
3. Lessee shall have the right to terminate this service agreement, for convenience, on the giving of 30 days prior written notice.
1.4. Lessor agrees to indemnify Lessee for any damages and/or costs incurred by Lessee or a third party as a result of Lessor’s breach of its obligations under this service agreement and/or the lease agreement, including for any disruption in the supply of electricity.
