Failure to pay wages
Any failure on the part of the employer to pay wages normally be a "fundamental breach of contract." This means the employee can treat the contract as being at an end, allowing him to leave his employment without the need to hand in his notice, and allowing him, if he chooses, to sue his employer for the unpaid remuneration. Nonetheless, it may be possible in particular circumstances that the an employer’s failure to pay wages which he is obliged to pay will not have such drastic legal consequences. He may merely be late in paying one week, which may not cause the employee any financial embarrassment.
