The facts of the second case in the scenario: Macmahon Mining Service and Cobar Management were parties to a design and construct agreement for the development of Cobar’s copper mine in Edinburg. The term of the contract is in 2 years, however when the term has finished not yet, Cobar issued a notice of termination to Macmahon based on the contractual provision entitling the party to end the contract for breach. Macmahon alleged that the termination was invalid and sued Cobar for damage. One of the heads of damage claimed is “loss of opportunity to earn profit”, and Macmahon claimed for £67,000,000. However, Cobor dismissed the claim of Macmahon based on the clause 18.5
