is a decision-making process that: (1) permits party participation
by submitting evidence and offering reasoned
arguments, and (2) requires an adjudicator to render a final
and binding decision that is (a) supportable based upon the
record and (b) the adjudicator’s independent judgment and
legal analysis.22 When adjudication is infected with partiality,
it is not based upon reasoned application of applicable
legal rules or premised upon the parties’ proofs – but rather
on a decision-maker’s personal relationships, preconceptions,
objectives and interests
