We stress the fact that at no time during the joint survey or ‘meeting’ were we involved in giving our approval or disapproval for the disposal of the cargo. The only action we took was to advise the consignee of his duty to mitigate loss and that the cargo did not warrant disposal. The decision to dispose the cargo or mitigate loss is clearly not ours to decide and we wish to emphasize that we did not in any way partake in the approval or disapproval of the shipment or, as alleged by the consignee, ‘changed our mind a few hours later.’
