Ms W, a post-operative male-to-female transsexual, sought judicial review to quash the refusal of the Registrar of Marriages to allow her to marry her male partner. W’s appeal proceeded on the basis that the right to marry under Article 37 of the Basic Law and Article 19(2) of the Hong Kong Bill of Rights relates to the right to marry a person of the opposite sex, and that it has nothing to do with same-sex marriage.
