11.2 Urban Land Reform Laws

A large portion of our population live in the urban areas. In the cities and municipalities, they find jobs
to support a living and yet they do not own land. They have become informal settlers, occupying public
domain, and even private properties as squatters. Laws were enacted to ease their plight are considered
as part of “Urban Land Reform.” Below is a summary of four (4) significant laws – PD 933, PD 1517,
RA 7270, and RA 10023. - compiled by Engr. Wilfredo L. Segovia

PD 933, Creating the Human Settlements Commission – May 13, 1976
Note: The Human Settlements Commission has been devolved to the HLURB
Declaration of Policies. (a) to liberate human communities from blight, congestion, and hazard, and to
promote development and modernization; (b) to bring about the optimum use of land; (c) to effect
rational interdependence of communities; (d) preserve and promote a dynamic balance between the
physical beauty and technology; (e) to realize those policies through the human settlements approach;
Definitions.
(a) "Development Plan" - documents, including maps, charts and other materials embodying goals and
proposals for the overall socio-economic growth and development of an area.
(b) "Human Settlements" - habitat or built environment of human beings encompassing both rural and
urban areas;"
(c) "Human Settlements Approach"- physical planning, improvement, and management of human
settlements.
(d) "Human Settlements Plan" – development plan translated to program of physical planning
activities, programs and projects, including its phasing, priorities, and financing.
(e) "Land Resource Management" - formulation of policies and programs for the general use of land,
preparation of land use plans, coordination among government agencies, administration and
implementation.
(f) "Local Planning Bodies" - offices or agencies lawfully entrusted with physical planning functions
in the local governments.
(g) "Physical Planning" - art and science of ordering and managing land use, siting of buildings and
transportation routes for economy, convenience and beauty.
(h) "Pilot or Experimental Projects" - any undertaking, activity, or operation, of more or less limited
duration.
(i) "Planned Area for New Development" - areas/area identified and segregated for overall and
integrated planning and development as a single unit or physical area.
(j) "Regional Planning Bodies" - agencies such as the Regional Development Councils (RDCs) which
are lawfully entrusted with physical planning functions in the region.
Human Settlements Commission – created under the Office of the President; composed of - (1) the
Deputy Director-General, NEDA; (2) the USEC of DPWTC; (3) USEC, Public Highways; (4) the
USEC, DENR; (5) USEC, DOJ; (6) USEC, Dept.of Local Government and Community Development;

Isang malaking bahagi ng aming populasyon ay naninirahan sa mga urban area. Sa mga lungsod at munisipalidad, sa tingin nila ay mga trabaho
upang suportahan ang isang living at pa hindi nila pagmamay-ari ng lupa. Sila ay naging mga impormal settlers, na sumasakop sa pampublikong
domain, at maging ang pribadong ari-arian bilang squatters. Batas ay pinagtibay upang mabawasan ang kanilang kalagayan ay isinasaalang-alang

Tandaan: Ang Human pakikipag-ayos Komisyon ay devolved sa HLURB
Pahayag ng Patakaran. (A) upang palayain pantao komunidad mula sa magwasak, pagsisikip, at mapanganib, at upang
magsulong ng pag-unlad at paggawa ng makabago; (B) upang dalhin ang tungkol sa mga pinakamabuting kalagayan paggamit ng lupa; (C) sa epekto
nakapangangatwiran pagtutulungan ng komunidad; (D) panatilihin at i-promote ang isang dynamic na balanse sa pagitan ng
pisikal na kagandahan at teknolohiya; (E) upang mapagtanto ang mga patakaran sa pamamagitan ng tao pakikipag-ayos diskarte;
Kahulugan.
(a) "Development Plan" - mga dokumento, kabilang ang mga mapa, mga chart at iba pang mga materyales embodying mga layunin at
mga panukala para sa pangkalahatang socio-ekonomiyang pag-unlad at pag-unlad ng isang lugar.
( b) "Human pakikipag-ayos" - tirahan o built kapaligiran ng tao sumasakop sa parehong rural at
urban area; "
(c) "Human pakikipag-ayos Diskarte" - pisikal na pagpaplano, pagpapabuti, at pamamahala ng mga tao

(d) "Human pakikipag-ayos Plan" --unlad plano isinalin sa programa ng pisikal na pagpaplano
gawain, programa at proyekto, kabilang ang mga phase, priyoridad, at pagtustos.
(e) "Resource Pamamahala ng Land" - pagbabalangkas ng mga patakaran at programa para sa pangkalahatang paggamit ng lupa,
paghahanda ng paggamit ng lupa ng mga plano , koordinasyon sa mga ahensya ng gobyerno, administrasyon at

(f) "Lokal Pagpaplano ng katawan" - opisina o ahensiya ipinagkatiwala ayon sa batas na may pisikal na pagpaplano function
sa mga lokal na pamahalaan.
(g) "Physical Planning" - sining at agham ng pag-order at pamamahala ng paggamit ng lupa , siting ng mga gusali at
. ruta ng transportasyon para sa ekonomiya, kaginhawahan at beauty
(h) "Pilot o Pang-eksperimentong proyekto" - anumang gawain, aktibidad, o pagpapatakbo, ng higit pa o mas mababa limitadong

(i) "binalak Area para sa Bagong Development" - lugar / area nakilala at segregated para sa pangkalahatang at
integrated na pagpaplano at pag-unlad bilang isang solong yunit o pisikal na lugar.

naaayon sa batas ay ipinagkatiwala sa mga pisikal na pagpaplano function sa . rehiyon
