Custom and practice is a phrase frequently encountered in the literature of industrial relations. It may relate to diverse areas such as manning levels, seniority or output. It is very often vague and undefined. As such, a custom in industrial may fail to meet the rigorous standards demanded by the law. Before being recognized as legally enforceable, a custom must be "reasonable", certain and notorious.” Moreover, legally binding customs be general throughout the country, or local throughout a district, or particular as applying to the usage of particular trades. Combinations of these are possible, such as a local custom in a particular trade {e.g. London Docks or the Lancashire weaving trade}. Custom and practice in industrial relations is often, but not always, confined to particular establishments. Moreover, custom and practice, as stated above, will often fail the tests of being "certain" and "notorious," even if held to be "reasonable.
