The employee was unable to recover any payment in the form of salary where the employers had in fact failed to determine any figure. The judge explained that the managing director was "at the mercy of the board; he gets what they determine to pay him, and, if they do not determine to pay him anything, he does not get anything." That was his contract with the company and those were the terms on which he accepted his appointment.
