Second Offense By A Minor
The second offense of a D.U.I. By A Minor, someone who is 17 years of age or older but less than 21 is still considered a Class C misdemeanor. This second conviction is punishable by a fine of up to $500. The community service part of the punishment is increased to a minimum of 40 hours but not more than 60 hours. The Alcohol Awareness Course may be required.
Third Offense By A Minor
The third offense of a D.U.I. By A Minor (17 years of age or older but less than 21) moves up in legal class to a Class B misdemeanor. This third offense substantially increases the fine. The minimum fine becomes $500 and it could be as high as $2,000. The community service stays the same on this third conviction at 40 hours but not more than 60 hours. On this third conviction jail time becomes an option as a form of punishment. This stay in jail can not exceed 180 days. Also, on this third conviction the court can not give deferred disposition. This basically means that this conviction is going on your record. On the first and second convictions the judge could keep this off of your record if you follow through with the judges requirements on time like paying fines, completing classes and/or community service.
