Neither the Seller nor the Buyer shall be held responsible for failing to perform the whole or parts of the contract, owing to “Force Majeure” causes. However in such a case, the affected party shall immediately notice the other party, within thirty (30) days after the accident and enough evidence to prove the occurrence and continuous of the accident should be submitted to the other party. If the said "Force Majeure" cause lasts over sixty (60) days,the Buyer shall have the right to cancel the whole or parts of the Contract.“Force Majeure” includes all incidents that happen after the signing date, unforeseen when signing the contract, unable to avoid and overcome the occurrence and results, and that prevent any of the parties to perform parts or the whole of the contract. The incidents should includes earthquake, typhoon, flood, fire, war, national or international transportations break off, governmental or official actions, epidemic, civil turbulence, strike and any other unforeseen or unavoidable or unconquerable incidents, including all incidents that conventionally considered as Force Majeures in international commercial practice.VII. NoticeAll notices should be sent to the other party according to the given address. If there is any change in the address, the party should notice the other party within 3 days.International Rules for the Interpretation of Trade TermsAll terms shall be subject to the International Rules for the Interpretation of Trade Terms (INCOTERMS 2000) provided by International Chamber of Commerce (ICC) unless otherwise stipulated herein.This contract comes into force on the date of signing date. This contract is signed with two (2) originals, and each party holds one. Each original and fax is equal in force.
