Both parties have agreed to enter into this Lease with the following contents:
ARTICLE 1: Party A has agreed to lease to Party B the entire of the house No.: 414/33B Cach Mang Thang Tam, Ward 11, District 3, HCMC with the total usable area of 55.18m2
Leasing purpose: to run head office
ARTICLE 2: Lease duration: 03 years from 07 December 2004 to 07 December 2007 inclusive.
ARTICLE 3: House rental: 10,000,000dongs/month
This rental is not included costs of power and water consumption. Upon the expiry date, if party B whishes to continue the lease, the house rental and lease duration shall be subject to both parties’ discussion
MODE OF PAYMENT:
- Payment shall be made in cash
- Payment shall be made for once on a monthly basis and on the first day of calendar year
ARTICLE 4: Responsibility of each Party
1. Party A’ s responsibilities:
- To deliver the said house with its equipment and facilities to Party B right on the date the Lease becomes effective. The delivery of house and its equipment shall be performed by the Minutes of delivery with both parties’ signature.
- To ensure the full and separate use right of the said house to Party B
- To be entitled to terminate the Lease before the expiry date if Party B does not make payment on the first day of each every calendar month as agreed upon the lease
2. Party B’ s responsibilities:
- To make payment to Party A in a timely manner.
- To use the house properly with leasing purpose. Any demand on house repair or upgrading for Party B’ s use arisen shall be subject to Party A’ s agreement and shall comply with stipulations on construction.
- To bear responsibility for the damages or loss of the household equipment and personal belongings and all the damages causing for the third party during the lease period.
- Not to transfer the Lease or sublease.
- To pay tax for house leasing, make payment for water and power bills monthly
ARTICLE 5: Both Parties’ s commitment:
- To perform the contents of the Lease.
- In the event that either Party wishes to end the Lease before the expiry date, a prior notice of at least 01 (one) month shall be given.
- Any dispute or breach of the lease arisen shall be subject to both Parties’ s discussion and agreement in the spirit of co-operation. Failure to reach an amicable settlement between the two parties shall result in the case referred to the competent agency for judgment.
This Lease is executed in 04 copies (comprising 02 pages each), of the same validity, and becomes effective since the date of signature.
