13. Indemnification

To the extent and proportion of its liability, the Seller shall indemnify and hold The Buyer harmless from any third party claim or the Losses (as defined below) incurred by The Buyer as a result of, or arising from The Seller’s fault, negligence or breach of The Contract or for any other reason attributable to The Seller, including any claim for personal injury or property damages caused by faulty design or workmanship of The Ride. To the extent and proportion of its liability, The Buyer shall indemnify and hold The Seller harmless from any third party claim arising from The Buyer’s breach of The Contract, including any claim for personal injury or property damages, and it is agreed, however, that The Buyer shall not be liable for any indirect damages including, but not limited to damage to or loss of property; lost business or profits; or increased capital of operating costs.
