As the constituency of international arbitration has
grown, there have been shifts in what is expected of arbitrators
– not just by the parties but perhaps by arbitrators
themselves, who come from an increasingly diverse group
who may have different assumptions of what constitutes
proper conduct.89 The IBA Guidelines on Conflicts of Interest90
are a very useful starting place, and we should “watch
this space” as the IBA is currently conducting analysis of the
utility of the rules.91
